AUMUND Fördertechnik GmbH (hereinafter “AUMUND” or “we”) operates the website https://aumund.com. Here we offer you the possibility to inform yourself about our group of companies as well as our services and products. In addition, we provide applicants with information on job vacancies and career development in our group of companies in our career section. 

We take care to handle your personal data responsibly and securely. In doing so, we treat the data protection and privacy of our website visitors with care. 

In the following, we inform you about the processing of personal data when using this website and the career section. 

Personal data is any data that can be related to a natural person, either directly or, for example, by bringing together different sources of information. This includes, for example, name, address, e-mail addresses or also the personal data that may be contained in a curriculum vitae or in a reference or certificate.

3. Collection of personal data when visiting our website

When you use the website for information purposes only, i.e. when you only view the website and do not transmit information to us in any other way, we collect various personal data that your browser transmits to our server. We collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security:

  • IP address
  • Date and time of the request
  • Time zone difference from Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Data volume transferred
  • Website from which the request comes
  • Browser
  • Operating system and its user interface
  • Language and version of the browser software.

These data with complete, possibly personal IP addresses, which are stored by us on our server for reasons of technical security, in particular to defend against attempted attacks, are deleted after 14 days at the latest.

The legal basis is Art. 6(1)(b) GDPR, as well as Art. 6(1)(c) GDPR in connection with Art. 32(1) GDPR and Section 13(7) of the Telemediengesetz (German Telemedia Act, “TMG”).

4. Cookies

In addition to the aforementioned data, cookies are stored on your terminal device when you use our website. Cookies are small text files that contain information about your use of our website and are stored on your terminal device in the browser you are using. Cookies cannot run programs or transmit viruses to your computer. They are used to enable certain functions and to make the website as a whole more user-friendly and effective.

5. Contact

You can send us an enquiry using our contact details provided on the website and via the contact forms offered. The personal data that you provide to us in the context of enquiries will be processed by us in order to handle and respond to your enquiry. Depending on the content of your enquiry, your data may be passed on to other companies in our group of companies. Data will not be passed on to other third parties unless you request this as part of your enquiry. 

The legal basis is Art. 6(1)(b) GDPR.

6. Usage statistics with Matomo

If you give us your consent to do so, we will create statistical evaluations with the help of a technical solution for recording and evaluating usage behaviour on websites in order to learn more about the actual use of our websites and, if necessary, to improve the websites. We use technical functions to anonymise your data as early as possible. We do not create user-specific profiles.

You can revoke your consent at any time with effect for the future by deactivating the “Statistics” function HERE. We will then no longer use your usage data to compile statistics.

The legal basis is Art. 6(1)(a) GDPR.

7. Recipients of data

Personal data processed in connection with the provision of this website will be disclosed to the following categories of recipients:

  • Providers of technical services (e.g. data centre services, job postings and application functions in the career section, Matomo) used by us as the processor.
  • Companies in our corporate group

8. Duration of the storage of data

Unless otherwise stated in this privacy policy, we will store your data for as long as is necessary to fulfil the relevant purpose (for example, processing a request you have made). 

This does not include data that we retain due to legal obligations (typically up to 10 years) or for the defence or assertion of legal claims (typically 3 years).

The legal basis is Art. 6(1)(c) GDPR (retention obligations), as well as Art. 6(1)(f) GDPR (legitimate interest is the defence or assertion of legal claims).

9. Your rights

You have the following rights with regard to personal data relating to you:

10. Objection to or revocation of the processing of your data

If you have given your consent to the processing of your data, you can revoke this consent at any time with effect for the future. Unless otherwise stated as part of the consent, please address any revocation to our contact details provided in Section 2.

Insofar as we base the processing of your personal data on the balance of interests (the legal basis is Art. 6(1)(f) GDPR), you can object to the processing. This is the case if the processing is not necessary, in particular, for the performance of a contract with you or is based on your consent. When exercising such an objection, we will ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will examine the merits of the case and either discontinue or adapt the data processing or show you our compelling legitimate grounds on the basis of which we will continue the processing. 

If you wish to object to direct advertising, no justification is required. Of course, we will not send you any advertising if you no longer wish to receive it.

11. Convenience functions

We use techniques such as Javascript and CSS (cascading style sheets) for an optimal presentation of our website (e.g. adaptation to different screen sizes, fade-in menu, input control of the contact form). You can disable the use of these techniques by making the appropriate settings in your browser. In this case, however, parts of our website would no longer be usable for you.

12. Automated decision making and legal obligation to provide data

Automated decision-making processes that could have legal effect on you or could significantly affect you in a similar way do not take place in connection with your use of this website.

You are not legally obliged to provide us with your data. However, if you do not provide us with certain data, you will not be able to use related offers on our website.

13. Our data in the company details & legal notice section and this privacy policy

We expressly object to the use of contact data published within the scope of the company details & legal notice obligation by third parties for sending advertising and information material that has not been expressly requested. We expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example by spam mails.

14. Changes to this privacy policy

We reserve the right to adapt this privacy policy in agreement with the statutory data protection regulations. You can view the current version at any time in the data protection section of our website.

15. Additional information for applicants

In the career section of our website, you can apply for a job or send an unsolicited application to companies in our corporate group. If necessary, we will forward your application to the company in our group to which you have applied. This company is then the controller under data protection law.

We, or the company to which you have applied, process the data you have provided in connection with your application in order to assess your suitability for the respective position or, if requested, for other vacancies in our companies and to carry out the application process.

If further data is processed as part of the current application procedure, you will be informed of this separately.

The legal basis is Art. 88(1) GDPR in conjunction with Section 26(1) of the Bundesdatenschutzgesetz (German Federal Data Protection Act, “BDSG”).

If special categories of personal data within the meaning of Art. 9(1) GDPR are processed (for example, if you inform us of the existence of a severe disability), this serves the purpose of exercising rights or fulfilling legal obligations under labour law, social security law and social protection law in the context of the application procedure. The legal basis for this processing is Art. 9(2)(b) GDPR in conjunction with Section 26(3) BDSG.

Within the companies, only those persons and departments (for example the HR department, specialist department, works council or representatives of the severely disabled) receive your personal data that need it to carry out the application procedure or to fulfil the legal obligations.

Your application will be deleted 6 months after completion of the application process, unless longer or shorter storage is required for legal or statutory reasons.

If you give us your consent, we will register your application in our applicant pool and, if applicable, contact you proactively to offer you a suitable position in a company of our corporate group. The legal basis is Art. (6)(1)(a) GDPR. You can revoke your consent at any time with effect for the future by informing us of your revocation via the contact details mentioned in section 2. In this case, we will delete your data from our applicant pool. Irrespective of this, we will delete your data from our applicant pool after one year at the latest.

You are not legally obliged to provide us with your data. However, if you do not provide us with any data, we will not be able to offer you a job at our companies.
